Terms of Service

Please read carefully. By creating an account or using Summit Spelling, you agree to these Terms. If you do not agree, do not use the service. Key points: subscriptions auto-renew; we do not issue pro-rata refunds; this service is educational only and is not a medical or therapeutic evaluation; our liability is limited.

1. About Summit Spelling

Summit Spelling is a web-based educational program operated by EduVenturing (“we,” “us,” or “our”) that provides structured literacy and spelling instruction for children, delivered to parents and teachers (“you”). These Terms of Service (“Terms”) govern all access to and use of the Summit Spelling service, website, and content.

2. Eligibility and Account Responsibility

You must be at least 18 years old to create an account. By registering, you represent that you are a parent, legal guardian, or licensed educator acting on behalf of the child who will use the service.

You are responsible for: (a) maintaining the confidentiality of your login credentials; (b) all activity that occurs under your account, including student accounts you create; (c) ensuring that any child using Summit Spelling has parental consent as required by law.

You agree to notify us immediately at eduventuring@gmail.com if you suspect unauthorized access to your account.

3. Free Tier and Paid Subscriptions

Free tier: All accounts receive permanent free access to Module 1 (Long A — all 5 days) and basic parent dashboard functionality. No payment information is required to access the free tier.

Paid subscriptions unlock all available spelling modules, morphology units, and review modules. Current pricing is:

  • Monthly: $9.99 per month
  • Annual: $79.00 per year (~$6.58/month)

Each subscription covers up to 2 students under one parent/teacher account.

Prices are in USD. We reserve the right to change prices with at least 30 days' advance notice to active subscribers by email. Price changes will not affect your current billing period — only renewals after the effective date.

4. Billing, Auto-Renewal, and Cancellation

Auto-renewal: All paid subscriptions renew automatically at the end of each billing period (monthly or annually) until canceled. By subscribing, you authorize EduVenturing to charge your payment method on a recurring basis at the then-current price. You will receive a reminder email before each annual renewal.

How to cancel:You may cancel your subscription at any time through the “Manage Subscription” link in your dashboard, which opens the Stripe billing portal. Cancellation is effective at the end of the current billing period — you retain full access until that date.

Refund policy: All sales are final. We do not provide pro-rata refunds for unused time in a billing period, including unused portions of an annual subscription. If you cancel an annual plan mid-year, access continues through the end of the paid period but no partial refund is issued. If you believe you were charged in error, contact us within 14 days at eduventuring@gmail.com and we will investigate.

Failed payments:If a payment fails, your account enters “past due” status. Paid module access will be suspended until payment is resolved. We will attempt to notify you by email. After 7 days without resolution, the subscription may be canceled.

Free trial / promotional pricing: We may offer promotional pricing or free trials at our discretion. Trial periods automatically convert to a paid subscription unless canceled before the trial ends.

5. Acceptable Use

You agree not to:

  • Share your account credentials with individuals outside your household or classroom
  • Allow more than one household or classroom to use a single paid account simultaneously
  • Reproduce, redistribute, resell, or sublicense any Summit Spelling curriculum content
  • Reverse engineer, decompile, or attempt to extract source code from the service
  • Use automated tools (bots, scrapers) to access the service
  • Attempt to circumvent subscription paywalls or access controls
  • Use the service for any unlawful purpose or in violation of any applicable law
  • Impersonate another person or entity
  • Upload or transmit harmful, offensive, or illegal content
  • Interfere with or disrupt the integrity or performance of the service

We reserve the right to suspend or terminate any account that violates these terms, without refund, at our sole discretion.

6. Intellectual Property

All content in Summit Spelling — including but not limited to curriculum design, word sequences, lesson structures, audio content, assessment frameworks, software code, and visual design — is the proprietary intellectual property of EduVenturing and is protected by United States copyright law and international treaties.

Your paid subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use Summit Spelling for personal household or single-classroom educational use only. This license does not include the right to copy, reproduce, distribute, publicly display, or create derivative works from any Summit Spelling content.

Any feedback, suggestions, or ideas you submit to us may be used by EduVenturing without obligation or compensation to you.

7. Student Data and Privacy

As the adult account holder, you are responsible for ensuring that any child you add to Summit Spelling has appropriate parental or guardian consent. Our collection and use of student data is governed exclusively by our Privacy Policy, which is incorporated into these Terms by reference.

We act as a service provider with respect to student educational records. We do not own student data, will not sell it, and will not use it for any purpose other than delivering the Summit Spelling educational program.

8. Educational Disclaimer

Summit Spelling is an educational program, not a clinical service. It does not constitute and should not be used as a substitute for a professional psychoeducational evaluation, learning disability diagnosis, speech-language pathology, special education assessment, Individualized Education Program (IEP), or any form of medical or therapeutic treatment.

Results will vary based on the individual child, consistency of use, and other factors outside our control. We make no guarantee of specific academic outcomes, grade-level performance, standardized test scores, or reading/writing proficiency gains.

If you have concerns about your child's learning, reading, or language development, please consult a qualified educational specialist, school psychologist, or healthcare provider.

9. Disclaimer of Warranties

THE SPELLBRIDGE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, UNINTERRUPTED ACCESS, OR ABSENCE OF ERRORS OR VIRUSES. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED.

We do not warrant the accuracy, completeness, or usefulness of any content on the platform. Any reliance you place on such content is strictly at your own risk.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EDUVENTURING, ITS OWNER, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL EDUVENTURING'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO EDUVENTURING IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) $50.00 USD.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless EduVenturing and its owner, employees, contractors, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (a) your use of or access to the service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any privacy or intellectual property right; or (d) any claim that your use of the service caused damage to a third party.

12. Termination

We reserve the right to suspend or terminate your account and access to Summit Spelling at any time, with or without notice, for conduct that we believe: violates these Terms; is harmful to other users, us, or third parties; or is otherwise objectionable. Upon termination, your right to use the service immediately ceases.

You may terminate your account at any time by requesting deletion at eduventuring@gmail.com. Termination does not entitle you to a refund for any prepaid subscription period.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions.

Informal resolution first: Before filing any formal legal claim, you agree to contact us at eduventuring@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days of receiving written notice.

If informal resolution fails, any dispute arising from or relating to these Terms or Summit Spelling shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. The arbitration shall be conducted in California. You waive any right to a jury trial or to participate in a class action lawsuit.

14. General Provisions

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and EduVenturing regarding Summit Spelling and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations.

Changes to these Terms:We may update these Terms from time to time. We will provide at least 14 days' notice by email for material changes. Continued use of Summit Spelling after the effective date constitutes acceptance of the revised Terms.
